Terms and Conditions

Leon Brothers Landscaping llc.

Effective Date: January 01, 2026

These Terms and Conditions (\"Agreement\") govern the provision of services by Leon Brothers Landscaping llc is a limited liability company organized and operating in the State of New Jersey. By engaging our services, you agree to be bound by the following terms.

1. Scope of Services

Leon Brothers Landscaping llc provides landscaping services, including but not limited to lawn maintenance, Spring and Fall Cleanup, Mulch, Trimming and pruning, planting beds care, Season flowers, Aeration and overseed, and much more and related services as agreed upon in writing.

All services will be outlined in a written estimate, proposal, or service agreement. Any additional services requested by the Client may be subject to additional charges.

2. Estimates and Pricing

All estimates are based on the information provided at the time of evaluation and are subject to change upon site inspection or changes in project scope.
Prices are valid for 30 days unless otherwise stated.
The Company reserves the right to revise pricing due to unforeseen conditions, material cost increases, or Client-requested modifications.

3. Payment Terms

Payment terms will be specified in the invoice or service agreement.
A deposit may be required prior to the commencement of work.
Full payment is due upon completion of services unless otherwise agreed in writing.
Late payments may be subject to a fee of $10 or 5% - 10% per month or the maximum permitted by New Jersey law.
The Client agrees to pay all reasonable collection costs incurred by the Company.

4. Scheduling and Access

The Client agrees to provide reasonable access to the property for the performance of services.
The Company is not responsible for delays caused by weather, unforeseen site conditions, or circumstances beyond our control.
Appointments may be rescheduled as necessary, and we will make reasonable efforts to notify the Client in advance.

5. Client Responsibilities

The Client agrees to:

Clearly identify property boundaries
Disclose any underground utilities, irrigation systems, or hazards
Secure pets and ensure safe working conditions
Obtain any necessary permits, unless otherwise agreed in writing

The Company shall not be liable for damage resulting from undisclosed conditions.

6. Changes and Cancellations

Any changes to the scope of work must be approved in writing and may affect pricing and timelines.
Cancellations must be made with reasonable notice. Deposits may be non-refundable depending on the stage of the project.
The Company reserves the right to terminate services for non-payment, unsafe conditions, or breach of this Agreement.

7. Warranty and Disclaimer

The Company will perform services in a professional and workmanlike manner consistent with industry standards.
No guarantees are made regarding plant survival due to factors beyond our control, including weather, soil conditions, pests, or improper maintenance by the Client.
Any warranties for materials or products are limited to those provided by the manufacturer.

8. Limitation of Liability

To the fullest extent permitted by New Jersey law, Leon Brothers Landscaping llc shall not be liable for:

Indirect, incidental, or consequential damages
Loss of use, property value, or profits
Damage arising from conditions beyond the Company’s control

The Company’s total liability shall not exceed the amount paid by the Client for the services rendered.

9. Insurance

The Company maintains appropriate insurance coverage as required by the State of New Jersey. Proof of insurance may be provided upon request.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes shall be resolved in the appropriate courts located within New Jersey.

11. Force Majeure

The Company shall not be held responsible for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, severe weather, labor disputes, or supply shortages.

12. Entire Agreement

These Terms and Conditions, together with any written estimate or service agreement, constitute the entire agreement between the parties and supersede all prior discussions or agreements.

13. Amendments

The Company reserves the right to update or modify these Terms and Conditions at any time. Updated versions will be provided upon request or made available to Clients.
